At its fifty-ninth session, in 2026, the Commission mandated Working Group II to provide feedback on the result of the work to be undertaken by the secretariat to monitor and examine issues on remote hearings in arbitration and remote mediation (including whether to mandate a working group to work on the topic) and to review: (i) the relationship between the UNCITRAL Arbitration Rules and the UNCITRAL Supplementary Provisions on the Conduct of Proceedings to Resolve International Investment Disputes (Supplementary Provisions), (ii) the advantages and disadvantages of different means to incorporate the Supplementary Provisions into the UNCITRAL Arbitration Rules, including any impact on the operation of the UNCITRAL Arbitration Rules, and (iii) the feasibility and desirability of incorporating the Supplementary Provisions into the body of the UNCITRAL Arbitration Rules (see A/81/17, paras. 167-181).
The Commission noted that such work should not result in reopening the text of the Supplementary Provisions or the issues that have been resolved therein and that the work should be reported back to the Commission (see A/81/17, para. 181).
